Privacy Policy & SMS Terms of Service

Kasteel Property Management, LLC (“Kasteel,” “we,” “our,” “us”) operates www.kasteelproperty.com (the “Site”). This page explains our policies regarding the collection, use, and disclosure of Personal Information we receive from users of the Site and from individuals who expressly opt in to our SMS text-messaging program.

By using the Site, you agree to the collection and use of information in accordance with this Privacy Policy and the SMS Terms of Service contained below. For full details on our SMS program, see the section titled “SMS Text-Messaging Terms of Service.”


1. Information We Collect

1.1 Website & Account Data

While using our Site, we may ask you to provide personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your name, contact information, etc.

1.2 SMS Opt-In Data

When you provide your mobile phone number and expressly opt in, we collect that number for the sole purpose of sending recurring automated and/or prerecorded SMS/text messages at your request. We do not share mobile numbers with third parties or affiliates for their marketing purposes. (See Section 8 for complete SMS Terms.)

2. How We Use Your Personal Information

We will use your Personal Information to:

  • Administer your account
    • Provide you with services and customer support
    • Respond to your requests, resolve disputes and/or troubleshoot problems
    • Verify your compliance with your obligations in our Terms of Service and other policies
    • Improve the quality of the Site and the services
    • Communicate with you about the Site and the services, including via SMS when you have expressly opted in (see section 8 for complete SMS Terms).
    • Market our products and services (and those of third parties) to you that we believe may be of interest to you

We will not sell your Personal Information to third parties.

3. Log Data

Like many site operators, we collect information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, and other statistics. We may use third-party services such as Google Analytics that collect, monitor, and analyze this information.

4. Cookies & Data Tracking

Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your computer’s hard drive. Like many sites, we may use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.

We retain information only as long as necessary to provide the services you request, to comply with legal obligations, and to enforce our agreements.

While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

You may review, update, or delete certain Personal Information by contacting us using the information at the end of this document. If you have opted into SMS messaging, you may revoke that consent at any time (see Section 8.3).

7. Changes to This Privacy Policy

This Privacy Policy is effective as of 09/19/2019 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. Your continued use of the Service after we post any modifications will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

8. SMS Text-Messaging Terms of Service

8.1 Consent & Message Types

By providing your mobile phone number and opting in, you expressly consent to receive recurring automated and/or prerecorded SMS/text messages from or on behalf of Kasteel Property Management, LLC at the mobile number you provide. Consent is not a condition of purchase or of receiving any goods or services.

What you may receive

  • Marketing & Promotional Messages (if you opt in): newsletters, market reports, links to properties, requests for reviews, survey invitations, event and promotion notices.
    Non-Marketing, Transactional or Service Messages (if you request a service such as a rent analysis): links to deliverables, follow-up questions needed to prepare a rent analysis, appointment reminders, and related service communications.

Messages may be sent using an automatic telephone dialing system (ATDS) and/or prerecorded message technology.  Your consent authorizes us to send such calls and texts to the number you provide.

8.2 Frequency & Fees

Message and carrier data rates may apply.  Message frequency varies based on your selections and interactions but will not exceed three (3) unsolicited marketing messages per week unless you opt into a higher-frequency program. Message and data rates may apply. If you have questions about your mobile plan or charges, contact your wireless provider. Carriers are not liable for delayed or undelivered messages.

8.3 User Rights, Opt-Out & Support

You and other users have the right to revoke consent and stop receiving messages at any time by texting STOP to 801-787-1177. After sending STOP, you will receive a confirmation message and will receive no further marketing messages from us. To re-enroll, sign up again through our standard opt-in method. 8.4 Age & Consent

You represent that you are the owner of the mobile number you provide and are at least 18 years old (or the age of majority in your jurisdiction). If you provide a number on behalf of someone else, you represent that you have authority to do so and to grant consent on their behalf.

8.5 Legal Disclaimers & Limits

Kasteel Property Management, LLC reserves the right to discontinue the messaging service to anyone at any time.
